1General BusinessDeclare that certain real property located at 90 Santa Rosa Avenue (0.7 acres), a portion of 100 Santa Rosa Avenue (4.52 acres), 631 1st Street (0.33 acres), and 655 1st Street (0.41 acres), consisting of APNs 009-073-023, 009-191-021 (Portion), 009-073-019, 009-073-020, 009- 073-021, 009-073-022 and 009-073-018 (collectively, “Exchange Property”) is exempt surplus land under the Surplus Land Act pursuant to Government Code section 54221(f)(1)(C);
Council will declare that certain city-owned properties on Santa Rosa Avenue and 1st Street are surplus land available for the proposed real estate exchange.
3General BusinessApprove the Lease form for the leaseback from MOTS LLC to City of a portion of 100 Santa Rosa Avenue for up to two years and 90 Santa Rosa Avenue for up to one year at a rate of $1.00 per year, prepaid at closing;
Council will approve a lease allowing the city to temporarily rent back portions of the properties it is selling for up to two years at $1 per year.
4General BusinessApprove the principal terms of, and authorize the City Manager to execute, an Assignment of Lease Agreement relating to the premises currently leased by MOTS LLC to Dickenson Peatman & Fogarty, PC (“DPF”) to facilitate the early transfer of certain City staff and operations to 520 3rd Street before Closing, and City’s payment of $55,877.50 for the agreed FF&E;
Council will authorize moving city staff and operations into the new City Hall location early by assigning an existing lease and paying $55,877.50 for equipment.
5General BusinessAdopt the California Environmental Quality Act (CEQA) findings pursuant to Public Resources Code section 21166 supporting approval of the Exchange and direct staff to prepare, execute and file a Notice of Determination with the County Clerk and State Clearinghouse;
Council will adopt environmental review findings for the real estate exchange and file required notices with the county and state.

Council will approve an extension to an existing maintenance contract for elevators and wheelchair lifts for three additional years.
15General BusinessREPORT ITEMS 15.1 REPORT - APPROVAL OF REAL PROPERTY EXCHANGE AGREEMENT FOR CITY HALL CAMPUS (90 & 100 SANTA ROSA AVENUE (PORTION), 631 & 655 1ST STREET) AND 520 3RD STREET; DECLARATION OF EXEMPT SURPLUS LAND; AND RELATED ACTIONS BACKGROUND: The proposed Exchange Agreement advances vital community benefits in Downtown Santa Rosa while delivering a fiscally responsible strategy to reduce taxpayer exposure to the significant costs, risks, and long-term liabilities associated with the current City
Council will consider swapping city-owned downtown properties with a private developer to consolidate city administrative offices into a single new City Hall location while reducing future maintenance costs and liabilities.
16General BusinessPUBLIC HEARINGS Public Hearing matters will begin no earlier than 5:00 p.m. or as soon thereafter as the matters are reached on the agenda. 16.1 PUBLIC HEARING - ORDINANCE INTRODUCTION - ORDINANCE ENTITLED: ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING SANTA ROSA CITY CODE CHAPTER 14-21, WATER WASTE REGULATIONS, TO INCLUDE DEFINITIONS, PROHIBITIONS ON IRRIGATION OF NONFUNCTIONAL TURF, COMPLIANCE DEADLINES AND ENFORCEMENT PROVISIONS BACKGROUND: The City’s Water Waste Regulations, first adopted in 1999 and last revised in 2023, defines water waste and authorizes customer notification, penalties and potential water service disconnection in cases of unaddressed violations. Since the Regulations were last revised, California Assembly Bill 1572 was signed into law in 2023 prohibiting the irrigation of nonfunctional turf with potable water at certain property types and establishing compliance timelines, including a mandate that local water providers codify the regulatory prohibition by January 1, 2027, and thus necessitating an update to the Water Waste Regulations. RECOMMENDATION: The Board of Public Utilities and Santa Rosa Water recommend that the Council approve the first reading and introduce an ordinance amending Santa Rosa City Code Chapter 14-21 Water Waste Regulations to include clarifying definitions, a prohibition
