PRESENTED BY: Jenny Marquez, Code Enforcement Officer II RECOMMENDATION: The City of Santa Rosa respectfully recommends that the Board of Building Regulations Appeals, upon reviewing this staff report and considering all relevant testimony and evidence presented during the Appeal Hearing, deny the appeal submitted by Greenberg Property Investments LP and uphold staff’s issuance of the Notice and Order to Vacate.

City staff is asking the Board of Building Regulations Appeals to uphold a vacate order for a unit at 2371 Corby Ave that was issued after an inspection found serious health and safety violations including a non-functioning heater with exposed wires, black mold throughout multiple rooms with high moisture levels, active cockroach and rodent infestations, deteriorating stairs, and broken plumbing. The property owner, Greenberg Property Investments LP, is challenging the vacate order and the tenant's eligibility for relocation assistance, but staff argues these are structural problems the landlord is responsible for maintaining regardless of tenant cooperation, and that the violations are severe enough to make the unit unhabitable under state housing codes.
